In a significant legal development, Nyck de Vries, previously with AlphaTauri in Formula 1, has been mandated by the Amsterdam District Court to return a substantial loan and part of his professional earnings to Investrand, the investment firm that supported his early career.

The initial investment by Investrand was contingent upon De Vries ascending to a Formula 1 role by 2022, a condition complicated by his surprise entry at the 2022 Italian Grand Prix as a replacement driver for Williams when Alex Albon was unexpectedly taken to hospital.

This unforeseen participation triggered a legal dispute over whether it fulfilled the criteria of the original loan agreement. Initially, De Vries appeared to have the upper hand when a judge ruled in his favour, stating his Monza appearance did not constitute a formal F1 racing contract. However, the latest court decision overturns this perspective, aligning with Investrand's interpretation of the agreement.

The recent ruling not only demands the repayment of the initial loan but also a significant share of De Vries' earnings from his time with AlphaTauri. Jeroen Schothorst, representing Investrand, expressed mixed feelings about the necessity of legal action, emphasising the company's initial support for De Vries during a critical phase of his career. Schothorst commented, as quoted by Motorsport.com:

“We supported Nyck at a crucial moment in his career, when no one else wanted to do so.

“I am happy that the judge has now ruled in our favour, although I of course regret that this procedure was necessary.

“We would have preferred to reach an arrangement without procedures through proper consultation, but unfortunately our attempts to do so were resolutely rejected by Nyck and his lawyer.

“This made going to court inevitable. That does not alter the fact that I wish Nyck all possible success in the continuation of his already impressive motorsport career, even though it will no longer be in F1."

Meanwhile, De Vries' legal team, led by Jeroen Bedaux, criticised the court's interpretation and hinted at the possibility of an appeal, pointing to a disconnect between the court's decision and the original intentions of the agreement.

“The court's interpretation of the agreement is not consistent with what De Vries in any event intended at the time he concluded the agreement.

“And De Vries has also fully and conscientiously fulfilled his obligations up to and including 2022, which has also been confirmed in court.

“That De Vries was nevertheless ordered to repay the loan and to pay fixed and variable interest regarding the first months of 2023 is therefore at odds with what the parties have agreed, which is why De Vries is still considering an appeal.”
