Wrongful Death Lawsuit Filed Against Hornets Forward Brandon Miller
A wrongful death lawsuit has been filed against former Alabama men's basketball players Darius Miles, Michael Davis, and Charlotte Hornets rookie Brandon Miller.
A 23-year-old woman, Jamea Jonae Harris, was fatally shot in Tuscaloosa near the school's campus last January. Miles and Davis have been charged with capital murder while Miller has not been charged with a crime and has been a cooperative witness.
According to police testimony, Miles asked Miller to bring the weapon before picking him up but Miller did not touch it “and never knew that illegal activity involving the gun would occur.”
Kirby D. Farris and Malia D. Tartt of the Farris, Riley & Pitt law firm in Birmingham, Alabama are the attorneys representing Decarla Raietta Heard, the mother of Jamea Jonae Harris in the case. The firm told ESPN they want to know all of the details of what happened that night that Harris was fatally shot.
"They would like to hear testimony from all three of the young men involved concerning what they did, said, and saw. The family would like the opportunity, through their attorneys, to investigate why and how the gun was brought to the scene of a confrontation that resulted in the death of their daughter. Once we have had the opportunity to evaluate the evidence in the case, we can make decisions about the degree of culpability, if any, of each."
In the US courts system a person can be liable in a civil action and but not guilty of a criminal act. Attorney John Robbins who is representing Michael Davies stated "Am I surprised that this lawsuit has been filed? No." This suggests all parties new a lawsuit has been on the cards for sometime.
