Report: Lawsuit Filed Against Joe Mixon From March Shooting
CINCINNATI — Bengals running back Joe Mixon is facing a lawsuit in the Hamilton County Clerk of Courts, stemming from the shooting incident at his property this past March. Fox19 first reported news of the lawsuit.
Authorities showed up at Mixon's house after Lamonte Brewer fired "11 shots" at a minor with a loaded assault rifle. Now, the minor is suing Mixon through his legal guardians, Dr. Jason and April Bell.
Mixon is being sued for "negligent entrustment, intentional infliction of emotional distress, negligent infliction of emotional distress, battery, negligence, nuisance," along with "punitive damages, loss of consortium, and general damages."
Part of the lawsuit describing the full incident is available below, "C.B." is the minor:
On March 6, 2023, Lamonte Brewer aimed a loaded assault rifle at minor, C.B., and fired a minimum of 11 rounds at C.B. while C.B. was on his own property. Joe Mixon was also in his own backyard with a loaded 9mm semi-automatic pistol at the time of the shooting. Upon information and belief, the weapon and military bullets 7.62mm rounds Lamonte Brewer used on March 6, 2023, were owned by Joe Mixon and that Joe Mixon provided the weapon and bullets to Lamonte Brewer at Joe Mixon’s home, which is next door to the Bell residence. C.B. was never on Joe Mixon’s property on March 6, 2023, and even if C.B. had been on Joe Mixon’s property, Lamonte Brewer had no legal right under Ohio Law to shoot at C.B. and attempt to kill C.B. Dr. Jason Bell, who was in his study facing Mixon’s home while the shooting occurred, watched in fear and horror as his son was being shot at from Mixon’s property.
Dr. Bell watched as dirt was kicked up near the windows of his study by several bullets hitting his landscaping. As C.B. was running for his life in his own yard away from the gunfire, he felt bullets hissing by his head, and was hit twice, once in the green, blue and gray colored toy Nerf Rifle he was carrying and again in his right foot by a 7.62mm round shot from Joe Mixon’s assault rifle used by Lamonte Brewer. Following being shot in the foot, C.B. was hiding in pain and bleeding behind a tree next to his house to avoid getting killed. As C.B. desperately feared for his life, he began to vigorously dig a hole with his hands in the mulch next to his father’s study.
C.B.’s brother yelled out from the front door of the Bell house at C.B. to get inside, but C.B. continued to hide fearing for his life. C.B. was eventually able to hobble into his home away from the shooting spree and was immediately treated for his foot wound by his father, Dr. Jason Bell. C.B. was later transported to Cincinnati Children’s Hospital for medical treatment for a right foot bullet injury. C.B. was treated at the emergency room on March 6 and the bullet was removed several weeks later by an orthopedic surgeon. C.B. has also received additional medical treatment for his injuries as well as psychological counseling for post-traumatic stress disorder, anxiety, and depression.
